GENERAL TERMS AND CONDITIONS

  • 1. SERVICE DESCRIPTION
  • 1.1 THE SERVICE
  • Id-Find provides its Subscribers with an object identification service based on a unique and confidential marking system that allows marked objects to be returned when they are found after having been separated from their owner in any way (hereinafter the Service). The marking of Subscribers' objects is done using metal tags (for keys in particular), PVC tags, or any other means of marking provided by Id-Find (stickers or other) (hereinafter referred to as the Marker). The return of an item to its owner is only possible with the voluntary and non-contractual participation of the person who finds it and contacts Id-Find through one of the communication channels provided for this purpose (Internet, call center, approved partners). Access to the service may require the use of non-proprietary means of communication such as a computer and the Internet, a telephone, etc. These are not included in this contract and their use by subscribers remains at their own expense.
  • 1.2 DURATION OF SERVICE
  • The Service commences upon conclusion of the contract or, where expressly provided for, upon activation of the Service by the Subscriber, and continues for the contractual term provided for.
  • 1.3 WARRANTY AND SERVICE LIMITATIONS
  • The return of items separated from their owner and bearing an Id-Find tag cannot be guaranteed. Id-Find cannot be held liable under any circumstances for the non-return of a misplaced, lost, or stolen item. No guarantee can be given on:
    • Damage sustained by an object.
    • The uses that may have been made of the item, as well as their consequences and costs.
    • Return of the item in its entirety. The Service provided does not include any compensation for the loss or damage of an item.
  • 2. SUBSCRIBERS' RIGHTS AND OBLIGATIONS
  • 2.1 PERSONAL INFORMATION
  • In order to benefit from the Service, Subscribers agree to:
    • a) to provide the necessary personal information required by Id-Find to activate the Service.
    • b) to keep this information up to date, to modify it, or to notify Id-Find of any changes to it.
    • c) activate the Service when necessary.
    The Subscriber is solely responsible for the validity of the personal information they have provided to Id-Find and for keeping it up to date. If the Subscriber fails to update their personal information, they may be charged a fee if Id-Find is forced to conduct searches in order to contact them.
  • 2.2 PERSONAL DATA AND PROTECTION
  • Subscribers have the right to view and modify their personal data at any time via the Id-Find website or by contacting the call centers. Personal information provided by Subscribers will only be used by Id-Find or its partners in the context of activities related to the Service or related operations. Id-Find undertakes to do everything reasonably required to guarantee the security of its Subscribers' personal information. However, Id-Find cannot be held liable in the event of damage or loss of data resulting from external intervention or force majeure. Only serious misconduct on the part of Id-Find or one of its employees may give rise to Id-Find's liability. Identification information will be retained for a period not exceeding one year after the expiry of the contract.
  • 2.3 SAFETY DATA
  • Depending on the type of product, Subscribers' personal information may be available online and protected by security data including a username and password or PIN (personal identification number). Subscribers are solely responsible for the confidentiality of their security data. They are liable for the financial consequences of any use of their security data by third parties. Id-Find recommends that its Subscribers do not disclose their security data to third parties and ensure that they change their original security data promptly.
  • 2.4 ACCESS TO ONLINE SERVICES AND CALL CENTERS
  • Id-Find provides its Subscribers with tools for managing their personal data via its website. However, the availability of the aforementioned management tools cannot be guaranteed at all times and for all systems. Id-Find makes its call center available to its Subscribers in accordance with the terms and conditions set out for the service purchased.
  • 3. RETURN OF FOUND ITEMS
  • 3.1 RETURN
  • As soon as a third party reports the identification number of an object equipped with an Id-Find tag to Id-Find, Id-Find will search for and contact the Subscriber owner as soon as possible to inform them of the location of their property and agree with them, if necessary, on the terms of its return.
  • 3.2 REPATRIATION AND INCIDENTAL EXPENSES
  • Before any item is repatriated, the Subscriber will be informed of the costs they will be responsible for and their consent will be required. Written confirmation may be requested from the Subscriber. The costs of repatriation and other related costs (customs, other import taxes, insurance, etc.) are the sole responsibility of the Subscriber. In some cases, an advance payment may be requested before the item is repatriated. Id-Find may refuse to undertake the repatriation of an item when:
    • is illegal
    • contains hazardous materials
    • is subject to restrictive customs regulations
    • is of a nature that makes repatriation difficult, impossible, or dangerous
    • is the subject of disputes regarding its ownership
    • must be recovered in disaster-stricken, dangerous, difficult-to-access, or conflict-affected areas
    • whose loss was clearly caused intentionally
    • whose repatriation incurs costs that would not be covered by its owner
    • when the Subscriber refuses to pay the repatriation costs or cover the compensation requested by the person who found the item.
  • 3.3 STORAGE, DAMAGE, AND OTHER COSTS
  • Id-Find never acts as a custodian or storage facility for lost property. If the person who found the item claims damages or costs resulting from the custody or storage of the item, the Subscriber is responsible for covering these costs.
  • 3.4 REWARDS AWARDED BY THE USER
  • Rewards may be given by the Service Subscriber to the person who found the item. No compensation or coverage of expenses is granted to the person who finds an item other than the reward if this is mentioned on the Id-Find tag attached to the item. Id-Find may, at the express request of both parties, provide them with their respective names and contact details, but does not act as an intermediary or mediator under any circumstances.
  • 3.5 CONTROL OF FOUND OBJECTS
  • In certain cases, Id-Find may conduct or arrange for the search, inventory, or evaluation of the recovered item before initiating a repatriation operation.
  • 3.6 SUBSCRIBER NOT WISHING TO COLLECT AN ITEM
  • If the subscriber does not wish to recover the found item, they must inform Id-Find during the preliminary telephone contact so that no steps are taken to return it. Written confirmation (by mail or email) must be sent to Id-Find as soon as possible. Upon receipt of confirmation of the Subscriber's refusal to retrieve the item, the Subscriber is deemed to have transferred ownership of the item to the person who found it. No subsequent claims of ownership will be accepted. Refusal to retrieve the item after the fact does not release the Subscriber from their obligation to retrieve it and bear the costs associated with doing so.
  • 4. FINAL PROVISIONS
  • 4.1 KITS DISTRIBUTED UNDER A THIRD-PARTY BRAND OR LICENSE
  • Id-Find products distributed under a third-party brand ("Advertiser") or license may be subject to specific provisions, particularly with regard to the duration of the Service, the terms and conditions of activation, identity declaration, data protection, or specific geographic limitations .
  • 4.2 REPLACEMENT OF LOST OR DAMAGED MARKERS
  • Lost markers will not be replaced. Damaged markers can be replaced free of charge by supplying a standard replacement kit if the damage is caused by a defect in the original product.
  • 4.3 TRANSFER OF THE CONTRACT
  • The contract between the Subscriber and Id-Find is non-transferable. The Markers may be distributed by the Subscriber to family members or close friends, but in all cases, the Subscriber remains the person whose name and contact details are registered in connection with the identification number.
  • 4.4 TERMINATION OF CONTRACT
  • Id-Find service contracts are, unless otherwise specified, fixed-term contracts that expire at their end date. They are only renewed at the express request of the Subscriber. Id-Find reserves the right to terminate the contract at any time if the Subscriber breaches their obligations, abuses the Service intentionally or negligently, or in any way contravenes the interests of Id-Find or the Service. In such cases, no refunds may be claimed for services not rendered.
  • 4.5 RETURN OF ITEMS AFTER THE END OF THE SERVICE
  • When, after the Service has expired, an item equipped with an Id-Find Marker is returned to its owner, a new service contract identical to the initial contract is concluded according to the current terms and rates. Failing this, the owner will pay the actual cost of the return.
  • 4.6 APPLICABLE LAW AND JURISDICTION
  • This contract is governed exclusively by Swiss law. For any dispute arising from this contract, the parties agree that the courts of the Canton of Bern shall have exclusive jurisdiction.
